Abstract

In the US hospital setting, risk management focuses on mitigating hospital exposure to loss from legal liability, including medical malpractice tort law claims. This chapter provides perspective on three critical components of the US medical malpractice tort law: process, substance, and justifi cation. Framed in this way, the discussion that follows illuminates both the practice and the policy that forms the foundation of US medical malpractice tort law.
